Please read these Terms of Service carefully. By accessing or using BikeFix Pune's doorstep bike service platform, you agree to be bound by these terms. If you do not agree, please do not use our services.
1. Service Description
1.1 Platform Nature
BikeFix Pune ("we," "us," or "our") operates as a lead generation and connection platform that connects bike owners ("customers" or "you") with verified independent mechanics and service providers ("Service Partners") for doorstep bike service in Pune and PCMC areas.
1.2 Not a Direct Service Provider
Important clarifications:
- We do NOT directly employ mechanics or provide bike services ourselves
- We facilitate connections between customers and independent Service Partners
- Service Partners are independent contractors, not our employees
- We are NOT liable for the actual service performed by Service Partners
1.3 Services Facilitated
Through our platform, you can book:
- General bike service and maintenance
- Engine repair and diagnostics
- Electrical system repair
- Oil change services
- Emergency breakdown assistance
- Washing and detailing
- Other motorcycle repair and maintenance services
2. Eligibility
To use our services, you must:
- Be at least 18 years old
- Have legal ownership or authorization to service the bike
- Provide accurate and complete information
- Be located within our service coverage areas (Pune & PCMC)
- Have a valid phone number and contact details
3. Booking and Service Process
3.1 Booking
- You can book services via our website, phone, or WhatsApp
- All bookings are subject to Service Partner availability
- We aim to confirm bookings within 2 hours
- Booking confirmation is NOT a guarantee of service (depends on Service Partner acceptance)
3.2 Service Partner Assignment
- We connect you with available verified Service Partners in your area
- Service Partner details (name, phone) will be shared after booking confirmation
- You may communicate directly with the assigned Service Partner
3.3 Service Execution
- Service is performed by the independent Service Partner, not by us
- You are responsible for providing accurate bike information and service requirements
- Any changes to service scope must be agreed upon with the Service Partner
4. Pricing and Payment
4.1 Pricing
- Service prices are displayed on our website and quoted at the time of booking
- Final price may vary based on actual work required and parts used
- Service Partner will inform you of any additional costs before proceeding
- You have the right to decline additional services
4.2 Payment Terms
- No Advance Payment: We do NOT collect advance payments
- Pay After Service: Payment is made directly to the Service Partner after service completion
- Payment Methods: Cash, UPI, online transfer (as agreed with Service Partner)
- Receipt: Always request and retain a service receipt
4.3 Platform Fee
Our service may include a small convenience fee for connecting you with Service Partners. This will be clearly disclosed in the final price.
5. Cancellation and Rescheduling
5.1 Customer Cancellation
- You may cancel bookings without charge if cancelled at least 2 hours before scheduled time
- Cancellations within 2 hours may incur a nominal cancellation fee (₹50-₹100)
- Repeated cancellations may result in service restrictions
5.2 Rescheduling
- You may reschedule bookings free of charge with at least 2 hours notice
- Subject to Service Partner availability
5.3 Service Partner Cancellation
- Service Partners may cancel due to unavoidable circumstances
- We will attempt to assign an alternative Service Partner
- You may cancel without penalty if alternative is not acceptable
6. Quality and Warranty
6.1 Service Quality
- We connect you with verified Service Partners
- Service quality is the responsibility of the Service Partner
- We encourage feedback and monitor Service Partner performance
6.2 Warranty
- Warranty terms are provided by the Service Partner, not by us
- Typical warranty: 7-30 days on service work and parts (varies by Service Partner)
- Warranty claims should be directed to the Service Partner
- We can assist in facilitating warranty resolution
6.3 Parts Quality
- Service Partners use genuine or high-quality aftermarket parts
- You may request specific part types/brands
- Part authenticity is the Service Partner's responsibility
7. Customer Responsibilities
As a customer, you agree to:
- Provide accurate bike information and service requirements
- Be present or have an authorized representative during service
- Provide safe working space for the Service Partner
- Ensure bike is accessible (keys, parking space, etc.)
- Verify work completion before making payment
- Treat Service Partners with respect
- Not request services for stolen or illegally obtained bikes
8. Limitation of Liability
Important Legal Disclaimer
8.1 Platform Liability
BikeFix Pune is a connection platform. We are NOT liable for:
- Quality, timeliness, or outcome of services performed by Service Partners
- Any damage to bike or property during service
- Injuries or accidents during service delivery
- Loss or theft of bike or belongings
- Disputes between you and Service Partners
- Service Partner negligence or misconduct
8.2 Maximum Liability
Our total liability to you for any claim shall not exceed the amount paid for the specific service in question, limited to a maximum of ₹5,000.
8.3 Service Partner Liability
The Service Partner performing the work is solely responsible for:
- Service quality and workmanship
- Damage caused during service
- Part quality and authenticity
- Warranty fulfillment
9. User Conduct
You agree NOT to:
- Misuse the platform or provide false information
- Harass, threaten, or abuse Service Partners
- Attempt to contact Service Partners outside our platform for future services (circumvention)
- Use the platform for illegal purposes
- Interfere with platform operations
- Copy, reproduce, or scrape platform content
- Post fake reviews or ratings
10. Intellectual Property
- All content on our website/platform is our property or licensed to us
- You may not use our brand name, logo, or content without permission
- Service Partners retain their own intellectual property rights
11. Privacy and Data Protection
Your use of our services is also governed by our Privacy Policy. We collect, use, and protect your data as described in that policy.

12.2 Mediation
We will attempt to mediate disputes between you and Service Partners in good faith.
12.3 Arbitration
Any disputes not resolved through negotiation shall be subject to arbitration under the Arbitration and Conciliation Act, 1996, conducted in Pune, Maharashtra.
12.4 Governing Law
These Terms are governed by the laws of India. Courts in Pune, Maharashtra have exclusive jurisdiction.
13. Termination
13.1 By You
You may stop using our services at any time.
13.2 By Us
We may suspend or terminate your access if you:
- Violate these Terms
- Engage in fraudulent or illegal activities
- Abuse or harass Service Partners
- Have repeated booking cancellations
14. Changes to Terms
We may modify these Terms at any time. Changes will be effective upon posting. Continued use of our services after changes constitutes acceptance of modified Terms.
15. Disclaimer of Warranties
Our platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including:
- No guarantee of uninterrupted or error-free service
- No guarantee of Service Partner availability
- No guarantee of specific service outcomes
- No warranty regarding Service Partner qualifications
16. Indemnification
You agree to indemnify and hold harmless BikeFix Pune, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights
- Your interactions with Service Partners
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and BikeFix Pune regarding use of our services.
